g\u00fcnl\u00fck devreler halinde en fazla iki kez bu haktan yararlanma hakk\u0131 Devlet memuruna tan\u0131makta ve ikinci on g\u00fcnl\u00fck s\u00fcrenin Devlet memurunun y\u0131ll\u0131k izninden d\u00fc\u015f\u00fclmesi gerekti\u011fine ayr\u0131ca i\u015faret edildi\u011finden, y\u0131ll\u0131k izin kullan\u0131p kullanmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n Devlet memurlar\u0131na birinci on g\u00fcnl\u00fck mazeret izni verilebilir ve bu izin y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclmez. \u0130kinci kez on g\u00fcn daha mazeret izni verilebilir ancak ikinci kez verilen mazeret izni y\u0131ll\u0131k izinden d\u00fc\u015f\u00fcl\u00fcr.<\/p><p align=\"LEFT\"><strong>Anahtar Kelimeler<\/strong>: Y\u0131ll\u0131k izin, mazeret izni<\/p><p align=\"LEFT\"><strong>1- G\u0130R\u0130\u015e<\/strong><\/p><p align=\"LEFT\">Devlet memurlar\u0131 ile ilgili haklar ba\u015fta Anayasam\u0131z olmak \u00fczere Devlet Memurlar\u0131 Kanunu ve \u00e7e\u015fitli kanunlarda yer alm\u0131\u015ft\u0131r. \u0130zin memura bir hak olarak tan\u0131nm\u0131\u015ft\u0131r. Devlet memurlar\u0131 da Devlet Memurlar\u0131 Kanununda g\u00f6sterilen s\u00fcre ve \u015fartlarla izin hakk\u0131na sahiptirler. Devlet Memurlar\u0131 Kanunu&#8217;nun 102 ve 103\u2019nc\u00fc maddelerinde y\u0131ll\u0131k izin ve y\u0131ll\u0131k izinlerin kullan\u0131lmas\u0131, 104 \u00fcnc\u00fc maddesinde ise mazeret izinleri d\u00fczenlenmi\u015ftir.<\/p><p align=\"LEFT\">Bu \u00e7al\u0131\u015fmam\u0131zda; \u2018y\u0131ll\u0131k izin, y\u0131ll\u0131k izinlerin kullan\u0131lmas\u0131, y\u0131ll\u0131k izinlerin devredilmesi, anal\u0131k izni, babal\u0131k izni, do\u011fum izni, evlenme izni, \u00f6l\u00fcm izni, s\u00fct izni ve di\u011fer mazeret izinleri ile ilgili 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunundaki h\u00fck\u00fcmlere de\u011finilecek ve mazeret izni y\u0131ll\u0131k izinden d\u00fc\u015f\u00fcl\u00fcr m\u00fc?\u2019 sorusu cevaplanmaya \u00e7al\u0131\u015f\u0131lacak, mevcut yasal d\u00fczenleme incelenip de\u011ferlendirilecektir.<\/p><p align=\"LEFT\"><strong>2- YILLIK \u0130Z\u0130N<\/strong><\/p><p align=\"LEFT\">Memurun \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcrece her y\u0131l almaya hakk\u0131 oldu\u011fu izin y\u0131ll\u0131k izindir. Y\u0131ll\u0131k iznin verili\u015f ve kullan\u0131\u015f \u015fekli ile \u015fartlar\u0131 Devlet Memurlar\u0131 Kanununda g\u00f6sterilmi\u015ftir1<\/p><p align=\"LEFT\">\u00c7al\u0131\u015fan insanlar\u0131n belirli bir s\u00fcre dinlenmeleri anayasal bir hakt\u0131r. Dinlenmek \u00e7al\u0131\u015fan\u0131n hakk\u0131d\u0131r (Anayasa Md.50). Bir y\u0131l s\u00fcreyle \u00e7al\u0131\u015fan devlet memurlar\u0131n\u0131n da belirli bir s\u00fcre dinlenmeleri sa\u011fl\u0131k ve ekonomik y\u00f6nlerden gereklidir. Bu nedenle kamu hizmeti g\u00f6ren devlet memurlar\u0131n\u0131n y\u0131ll\u0131k izinlerinin verili\u015f ve kullan\u0131\u015f \u015fekli ile \u015fartlar\u0131 Devlet Memurlar\u0131 Kanununda g\u00f6sterilmi\u015ftir.2<\/p><p align=\"LEFT\">Buna g\u00f6re, Devlet memurlar\u0131n\u0131n y\u0131ll\u0131k izin s\u00fcresi, hizmeti bir y\u0131ldan on y\u0131la kadar (On y\u0131l dahil) olanlar i\u00e7in yirmi g\u00fcn, hizmeti on y\u0131ldan fazla olanlar i\u00e7in otuz g\u00fcnd\u00fcr. Zorunlu hallerde bu s\u00fcrelere gidi\u015f ve d\u00f6n\u00fc\u015f i\u00e7in en \u00e7ok iki\u015fer g\u00fcn eklenebilir (Md.102).<\/p><p align=\"LEFT\">Hizmeti bir y\u0131ldan az olan Devlet memurlar\u0131n\u0131n y\u0131ll\u0131k izin hakk\u0131 bulunmamaktad\u0131r. Ancak, birinci y\u0131l\u0131n dolduruldu\u011fu g\u00fcn\u00fc takip eden g\u00fcnden itibaren yirmi g\u00fcn y\u0131ll\u0131k izin kullan\u0131m\u0131 m\u00fcmk\u00fcnd\u00fcr. Kamu \u0130darelerinde, bir y\u0131l\u0131n\u0131 doldurmayan aday memurlara y\u0131ll\u0131k izin kulland\u0131r\u0131lmayacak, bir y\u0131ll\u0131k hizmetini dolduran aday memurlara ise yaln\u0131zca bir y\u0131l\u0131n dolduruldu\u011fu y\u0131l\u0131n izni olan yirmi g\u00fcn izin verilebilecektir.3<\/p><p align=\"LEFT\">\u00d6rne\u011fin; 24.05.2011 tarihinde aday memur olarak g\u00f6reve ba\u015flayan Vergi M\u00fcfetti\u015f Yard\u0131mc\u0131s\u0131, ancak bir y\u0131ll\u0131k s\u00fcreyi dolduraca\u011f\u0131 24.05.2012 tarihinde ve 2012 y\u0131l\u0131 iznine hak kazanacakt\u0131r.<\/p><p align=\"LEFT\">Ayr\u0131ca, kamuda ge\u00e7en hizmetler dikkate al\u0131n\u0131r, resmi kurumlardaki hizmeti bir y\u0131ldan az olan devlet memurlar\u0131n\u0131n y\u0131ll\u0131k izin hakk\u0131 bulunmamaktad\u0131r. \u201chizmet\u201d deyiminden, hangi stat\u00fcde olursa olsun sadece resmi kurumlar\u0131nda ge\u00e7mi\u015f hizmet s\u00fcreleri toplam\u0131n\u0131n anla\u015f\u0131lmas\u0131 gerekmektedir. Muvazzaf askerlikte ve yedek subayl\u0131kta okul devresinde ge\u00e7en s\u00fcreler de ayn\u0131 bi\u00e7imde dikkate al\u0131nacakt\u0131r4.<\/p><p align=\"LEFT\">Dan\u0131\u015ftay bir karar\u0131nda \u00f6zetle; \u00f6zel sekt\u00f6rde sigorta primi \u00f6demek suretiyle ge\u00e7en s\u00fcrenin memuriyette ge\u00e7en s\u00fcrelerden say\u0131lmas\u0131 m\u00fcmk\u00fcn olmad\u0131\u011f\u0131ndan, memuriyette ge\u00e7en hizmet s\u00fcresi 10 y\u0131l\u0131 a\u015fmayan davac\u0131n\u0131n y\u0131ll\u0131k izin s\u00fcresinin 20 g\u00fcn olarak tespit edilmesi i\u015fleminde hukuka ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131na karar vermi\u015ftir (Dan\u0131\u015ftay 5.Dairesinin 3.5.1984 tarih ve K: 84\/2096 say\u0131l\u0131 Karar\u0131). Dan\u0131\u015ftay bir ba\u015fka karar\u0131nda ise; \u00f6zel \u015fahsa ait bir fabrikada i\u015f\u00e7i stat\u00fcs\u00fcnde ge\u00e7en hizmet s\u00fcresi ilgili memurun emekli intibak\u0131nda de\u011ferlendirilmi\u015f olsa bile, y\u0131ll\u0131k izin s\u00fcresinin takibinde dikkate al\u0131nmayaca\u011f\u0131na karar vermi\u015ftir. (Dan\u0131\u015ftay 12.Dairesinin 5.11.1998 tarih ve E. 1995\/4297, K. 1998\/2646 say\u0131l\u0131 Karar\u0131) Say\u0131\u015ftay ise bir karar\u0131nda \u00f6zet olarak; s\u00fcrekli g\u00f6revle yurtd\u0131\u015f\u0131nda bulunan memurun, yurti\u00e7inde kulland\u0131\u011f\u0131 y\u0131ll\u0131k izin, mazeret izni ve sa\u011fl\u0131k izni s\u00fcrelerinde de yurtd\u0131\u015f\u0131 ayl\u0131\u011f\u0131n\u0131n \u00f6denmeye devam edilece\u011fine karar vermi\u015ftir (Say\u0131\u015ftay Temyiz Kurulunun 2.2.2000 tarihli ve K:24674 say\u0131l\u0131 Karar\u0131).<\/p><p align=\"LEFT\">Devlet memurlar\u0131n\u0131n yirmi veya otuz g\u00fcnl\u00fck izne hak kazanma tarihi ile ilgili olarak, birinci y\u0131l\u0131n dolduruldu\u011fu g\u00fcn\u00fc takip eden g\u00fcnden itibaren yirmi g\u00fcn y\u0131ll\u0131k izin kullan\u0131m\u0131 m\u00fcmk\u00fcnd\u00fcr. \u00d6te yandan, onuncu y\u0131l\u0131n tamamland\u0131\u011f\u0131 g\u00fcn\u00fc takip eden g\u00fcnden itibaren otuz g\u00fcn izne hak kazan\u0131lmakta olup, bu izne hak kazanmadan \u00f6nce y\u0131ll\u0131k iznin tamam\u0131n\u0131n veya bir k\u0131sm\u0131n\u0131n kullan\u0131lm\u0131\u015f olmas\u0131 bu hakk\u0131 ortadan kald\u0131rmaz.5<\/p><p align=\"LEFT\">Buna g\u00f6re; 31.12 tarihinde g\u00f6reve ba\u015flayan Devlet memurunun, birinci veya onuncu y\u0131l\u0131n\u0131 tamamlad\u0131\u011f\u0131 31.12 tarihinde 20 veya 30 g\u00fcn izin hakk\u0131 bulunmaktad\u0131r. Devlet memuru bu iznini; 31.12 tarihinden ba\u015flayarak kullanabilece\u011fi gibi, takip eden y\u0131la devretmek suretiyle de kullanabilecektir.6<\/p><p align=\"LEFT\">Y\u0131ll\u0131k izinler, amirin uygun bulaca\u011f\u0131 zamanlarda, toptan veya ihtiyaca g\u00f6re k\u0131s\u0131m k\u0131s\u0131m kullan\u0131labilir. Birbirini izliyen iki y\u0131l\u0131n izni bir arada verilebilir. Cari y\u0131l ile bir \u00f6nceki y\u0131l hari\u00e7, \u00f6nceki y\u0131llara ait kullan\u0131lmayan izin haklar\u0131 d\u00fc\u015fer (Md.103)<\/p><p align=\"LEFT\">Burada yer alan ve amire izinlerin kullan\u0131lma zaman\u0131n\u0131 saptama konusunda tan\u0131nan yetkinin amac\u0131; amirin memurunu g\u00f6zetme y\u00fck\u00fcm\u00fcn\u00fcn do\u011fal bir sonucu oldu\u011fundand\u0131r.<\/p><p align=\"LEFT\">Y\u0131ll\u0131k izinlerin kullan\u0131lma zaman\u0131 konusunda amirlere yetki tan\u0131nm\u0131\u015ft\u0131r. Ayr\u0131ca y\u0131ll\u0131k izinlerin ait oldu\u011fu y\u0131l i\u00e7inde kullan\u0131lmas\u0131n\u0131n as\u0131l, o y\u0131la ait kullan\u0131lmayan iznin ise istisnai bir durum olmas\u0131 nedeniyle, y\u0131ll\u0131k izinlerin kullan\u0131lmas\u0131nda temel ilke; her kamu idaresinde mevcut personelin hizmeti aksatmayacak bir \u015fekilde izin kullanmalar\u0131n\u0131n sa\u011flanmas\u0131 olmal\u0131d\u0131r. Bu ama\u00e7la, kamu idarelerinde izin vermeye yetkili amirler, Devlet memuruna hizmetin aksamadan devam\u0131n\u0131 sa\u011flayacak \u015fekilde ve \u00f6nceden haz\u0131rlad\u0131\u011f\u0131 bir plan \u00e7er\u00e7evesinde izin kulland\u0131rmal\u0131d\u0131r.7<\/p><p align=\"LEFT\">Y\u0131ll\u0131k izinlerin tamam\u0131n\u0131n veya bir k\u0131sm\u0131n\u0131n ait oldu\u011fu y\u0131l i\u00e7inde kullan\u0131lamamas\u0131 durumunda kullan\u0131lamayan y\u0131ll\u0131k izin, bir sonraki y\u0131l\u0131n izni ile birlikte toptan veya k\u0131s\u0131m k\u0131s\u0131m kullan\u0131labilecektir.8<\/p><p align=\"LEFT\">Devlet memurlar\u0131nca kullan\u0131lmayan izinlerin m\u00fcteakip y\u0131lda kullan\u0131labilmesi i\u00e7in memur taraf\u0131ndan dilek\u00e7e verilmesine veya \u0130dare taraf\u0131ndan onay al\u0131nmas\u0131na gerek bulunmamaktad\u0131r.<\/p><p align=\"LEFT\">Kamu personelinin bir \u00f6nceki y\u0131ldan devreden izni ile cari y\u0131l izni toplam\u0131n\u0131n k\u0131smen veya tamamen kullan\u0131lamamas\u0131 halinde, sadece cari y\u0131l iznine tekab\u00fcl eden k\u0131sm\u0131n\u0131n bir sonraki y\u0131lda kullanmas\u0131 m\u00fcmk\u00fcn bulunmaktad\u0131r. Bu \u015fekilde y\u0131l i\u00e7inde kullan\u0131lan izinler \u00f6ncelikle bir \u00f6nceki y\u0131ldan devreden izin s\u00fcrelerinden mahsup edilecektir.<\/p><p align=\"LEFT\">\u00d6rne\u011fin; 10 y\u0131ldan az hizmeti olan bir Vergi M\u00fcfetti\u015fi, 2011 y\u0131l\u0131 i\u00e7inde hi\u00e7 izin kullanmam\u0131\u015f ise, kullanmad\u0131\u011f\u0131 20 g\u00fcn s\u00fcreli iznini 2012 y\u0131l\u0131 sonuna kadar kullanabilecektir.<\/p><p align=\"LEFT\">\u00d6rne\u011fin; 10 y\u0131ldan fazla hizmeti olan bir Vergi M\u00fcfetti\u015fi, 2011 y\u0131l\u0131nda kullanamad\u0131\u011f\u0131 15 g\u00fcn, 2012 y\u0131l\u0131na ili\u015fkin 30 g\u00fcn olmak \u00fczere toplam 45 g\u00fcn olan 2011-2012 y\u0131llar\u0131 izninin 20 g\u00fcn\u00fcn\u00fc kullanm\u0131\u015f ancak 25 g\u00fcn\u00fcn\u00fc kullanamam\u0131\u015f ise kullanamad\u0131\u011f\u0131 izin 2012 y\u0131l\u0131na ait oldu\u011fundan kalan 25 g\u00fcnl\u00fck izni, 2013 y\u0131l\u0131 i\u00e7inde kullanabilecektir.<\/p><p align=\"LEFT\">\u00d6rne\u011fin; hizmeti 10 y\u0131ldan az olan bir Vergi M\u00fcfetti\u015fi 35 g\u00fcn olan 2011-2012 y\u0131llar\u0131 izninin 10 g\u00fcn\u00fcn\u00fc 2012 y\u0131l\u0131nda kullan\u0131p, 25 g\u00fcn\u00fcn\u00fc kullanamamas\u0131 halinde, 2012 y\u0131l\u0131na ait izin s\u00fcresi 20 g\u00fcn, 2011 y\u0131l\u0131na ait izin s\u00fcresi ise 5 g\u00fcn oldu\u011fundan 2011 y\u0131l\u0131na ait 5 g\u00fcnl\u00fck izin 2013 y\u0131l\u0131na devretmeyecek, 2013 y\u0131l\u0131na sadece 2012 y\u0131l\u0131na ait 20 g\u00fcnl\u00fck izin devredecek ve ilgili 2013 y\u0131l\u0131nda toplam 40 g\u00fcn izin kullanabilecektir.<\/p><p align=\"LEFT\">Bir \u00f6nceki y\u0131ldan devreden izin s\u00fcresinin mutlaka devretti\u011fi y\u0131l i\u00e7inde kullan\u0131lmas\u0131 gerekmektedir. Bu \u015fekilde devreden ve kullan\u0131lmayan izin s\u00fcresi m\u00fcteakip y\u0131lda kullan\u0131lamayacakt\u0131r.9<\/p><p align=\"LEFT\">\u00d6rne\u011fin; 10 y\u0131ldan fazla hizmeti olan bir Vergi M\u00fcfetti\u015fi, 2011 y\u0131l\u0131ndan devreden 20 g\u00fcnl\u00fck iznini devretti\u011fi 2012 y\u0131l\u0131na ait y\u0131ll\u0131k izni ile birlikte (toplam 50 g\u00fcn) 20.12.2012 tarihinden itibaren kullanmak istemesi halinde 2012 y\u0131l\u0131 i\u00e7inde 2011 y\u0131l\u0131na ait sadece 12 g\u00fcn (20.12.2012 \u2013 31.12.2012) izin kullanabilece\u011finden ve 2011 y\u0131l\u0131 izninin hi\u00e7 bir \u015fekilde 2013 y\u0131l\u0131na devretmemesi gerekti\u011finden, ilgiliye en fazla 42 g\u00fcn izin verilebilecektir. 2011 y\u0131l\u0131na ait kullan\u0131lamayan 8 g\u00fcnl\u00fck izin hakk\u0131 d\u00fc\u015fm\u00fc\u015f olacakt\u0131r.<\/p><p align=\"LEFT\"><strong>3- MAZERET \u0130ZN\u0130<\/strong><\/p><p align=\"LEFT\">Kamu \u0130darelerinde 657 say\u0131l\u0131 Kanuna tabi memurlara, zorunlu nedenlere ve kabul edilebilir \u00f6z\u00fcrlerine dayan\u0131larak y\u0131ll\u0131k izinlerine ek olarak verilen, baz\u0131 hallerde amirin takdirine baz\u0131 hallerde ise amirin takdirine b\u0131rak\u0131lmayan izin t\u00fcr\u00fcne mazeret izni denilmektedir.10<\/p><p align=\"LEFT\">Mazeret izinleri, mazeret izinlerinin verili\u015f, kullan\u0131\u015f \u015fekil \u015fartlar\u0131 ile s\u00fcresi Devlet Memurlar\u0131 Kanununda g\u00f6sterilmi\u015ftir. Buna g\u00f6re; 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun 6111 say\u0131l\u0131 Kanunla de\u011fi\u015fik 104 nc\u00fc maddesinin (A), (B) ve (D) f\u0131kralar\u0131nda verilmesi kanunen zorunlu olan mazeret izinleri,(C) f\u0131kras\u0131nda ise amirin uygun bulmas\u0131 halinde verilen mazeret izni d\u00fczenlenmi\u015ftir.11<\/p><p align=\"LEFT\">Kamuoyunda \u201cTorba Kanun\u201d olarak adland\u0131r\u0131lan 13.02.2011 tarihli ve 6111 say\u0131l\u0131 \u201cbaz\u0131 alacaklar\u0131n yeniden yap\u0131land\u0131r\u0131lmas\u0131 ile Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu ve di\u011fer baz\u0131 kanun ve kanun h\u00fckm\u00fcnde kararnamelerde de\u011fi\u015fiklik yap\u0131lmas\u0131 hakk\u0131nda kanun\u201d 25.02.2011 tarihli ve 27857 (m\u00fckerrer) say\u0131l\u0131 Resmi Gazete`de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. Torba kanunla vergi ve prim alacaklar\u0131n yeniden yap\u0131land\u0131r\u0131lmas\u0131 yan\u0131nda, kamu personelini ilgilendiren 657 say\u0131l\u0131 Kanunda, 375 ve 399 say\u0131l\u0131 kanun h\u00fckm\u00fcnde kararnamelerde de\u011fi\u015fiklik yap\u0131larak, kamu personelinin sosyal ve mali haklar\u0131nda iyile\u015ftirmeler de yap\u0131lm\u0131\u015ft\u0131r. Torba Kanunla memurlara y\u00f6nelik sosyal i\u00e7erikli iyile\u015ftirmelerden biride mazeret izin s\u00fcrelerinin art\u0131r\u0131lm\u0131\u015f ve kapsam\u0131 geni\u015fletilmi\u015ftir.<\/p><p align=\"LEFT\"><strong>3.1- Devlet Memurlar\u0131na Verilmesi Kanunen Zorunlu Olan Mazeret \u0130zinleri<\/strong><\/p><p align=\"LEFT\">A\u015fa\u011f\u0131da say\u0131lan mazeret izinlerinde \u00f6nemli olan husus, amire takdir hakk\u0131 tan\u0131nmamas\u0131d\u0131r. Yani do\u011fum, evlenme ve \u00f6l\u00fcm halinin vuku bulmas\u0131 durumunda Devlet memuru mazeret izni talep ederse verilmesi gerekir (S\u00f6kmen, 1996:116).<\/p><p align=\"LEFT\">Ayr\u0131ca, verilmesi kanunen zorunlu olan mazeret izinleri bu olaylar\u0131n vukuundan itibaren Devlet memurlar\u0131nca kullan\u0131lmas\u0131 gerekir. Yani olay\u0131n vuku Devlet memurunun bu izni hak kazanmas\u0131n\u0131 sa\u011flar. Do\u011fum, evlenme ve \u00f6l\u00fcm izinlerinin her biri ayr\u0131 ayr\u0131 mazeretler olmas\u0131 dolay\u0131s\u0131yla Devlet memurlar\u0131na verilecek mazeret izini de do\u011fum, evlenme ve \u00f6l\u00fcm i\u00e7in ayr\u0131 ayr\u0131 olacakt\u0131r.12<\/p><p align=\"LEFT\"><strong><em>3.1.1- Anal\u0131k \u0130zni<\/em><\/strong><\/p><p align=\"LEFT\">Do\u011fum \u00d6ncesi: 8 (3) hafta<\/p><p align=\"LEFT\">Do\u011fum Sonras\u0131: 8 (+5) (+ erdo\u011fum) hafta<\/p><p align=\"LEFT\">\u00c7o\u011ful gebelikte, do\u011fum \u00f6ncesi anal\u0131k izni 10 haftad\u0131r.<\/p><p align=\"LEFT\">Kamu \u0130darelerinde, 657 say\u0131l\u0131 Kanuna tabi kad\u0131n memura; do\u011fumdan \u00f6nce sekiz, do\u011fumdan sonra sekiz hafta olmak \u00fczere toplam onalt\u0131 hafta s\u00fcreyle anal\u0131k izni verilir. \u00c7o\u011ful gebelik durumunda, do\u011fum \u00f6ncesi sekiz haftal\u0131k anal\u0131k izni s\u00fcresine iki hafta eklenir. Ancak beklenen do\u011fum tarihinden sekiz hafta \u00f6ncesine kadar sa\u011fl\u0131k durumunun \u00e7al\u0131\u015fmaya uygun oldu\u011funu tabip raporuyla belgeleyen kad\u0131n memur, iste\u011fi h\u00e2linde do\u011fumdan \u00f6nceki \u00fc\u00e7 haftaya kadar kurumunda \u00e7al\u0131\u015fabilir. Bu durumda, do\u011fum \u00f6ncesinde bu rapora dayanarak fiilen \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcreler do\u011fum sonras\u0131 anal\u0131k izni s\u00fcresine eklenir.<\/p><p align=\"LEFT\">Do\u011fumun erken ger\u00e7ekle\u015fmesi sebebiyle, do\u011fum \u00f6ncesi anal\u0131k izninin kullan\u0131lamayan b\u00f6l\u00fcm\u00fc de do\u011fum sonras\u0131 anal\u0131k izni s\u00fcresine ilave edilir (Md.104\/A).<\/p><p align=\"LEFT\"><strong><em>3.1.2- Babal\u0131k \u0130zni<\/em><\/strong><\/p><p align=\"LEFT\">E\u015fi do\u011fum yapan; 10 g\u00fcn<\/p><p align=\"LEFT\">Do\u011fumda\/do\u011fumdan sonra e\u015fin \u00f6lmesi; anne i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcre kadar<\/p><p align=\"LEFT\">Do\u011fumda veya do\u011fum sonras\u0131nda anal\u0131k izni kullan\u0131l\u0131rken annenin \u00f6l\u00fcm\u00fc h\u00e2linde, iste\u011fi \u00fczerine memur olan babaya anne i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcre kadar izin verilir (Md.104\/A).<\/p><p align=\"LEFT\">Kamu \u0130darelerinde 657 say\u0131l\u0131 Kanuna tabi memurlara, e\u015finin do\u011fum yapmas\u0131 h\u00e2linde, iste\u011fi \u00fczerine on g\u00fcn babal\u0131k izni verilir (Md.104\/B).<\/p><p align=\"LEFT\"><em><strong>3.1.3- Evlenme \u0130zni<\/strong><\/em><\/p><p align=\"LEFT\">Kendisi i\u00e7in; 7 g\u00fcn<\/p><p align=\"LEFT\">\u00c7ocu\u011fu i\u00e7in; 7 g\u00fcn<\/p><p align=\"LEFT\">Devletlerde 657 say\u0131l\u0131 Kanuna tabi memurlara, kendisinin veya \u00e7ocu\u011funun evlenmesi h\u00e2linde iste\u011fi \u00fczerine yedi g\u00fcn izin verilir (Md.104\/B).<\/p><p align=\"LEFT\"><em><strong>3.1.4- \u00d6l\u00fcm \u0130zni<\/strong><\/em><\/p><p align=\"LEFT\">E\u015f, \u00e7ocuk, ana, baba, karde\u015f; 7 g\u00fcn<\/p><p align=\"LEFT\">E\u015finin ana, baba, karde\u015f; 7 g\u00fcn<\/p><p align=\"LEFT\">Kamu idarelerinde 657 say\u0131l\u0131 Kanuna tabi memurlara, e\u015finin, \u00e7ocu\u011funun, kendisinin veya e\u015finin ana, baba ve karde\u015finin \u00f6l\u00fcm\u00fc h\u00e2llerinde iste\u011fi \u00fczerine yedi g\u00fcn izin verilir (Md.104\/B).<\/p><p align=\"LEFT\"><strong><em>3.1.5- S\u00fct \u0130zni<\/em><\/strong><\/p><p align=\"LEFT\">\u0130lk alt\u0131 ayda g\u00fcnde \u00fc\u00e7 saat, ikinci alt\u0131 ayda g\u00fcnde birbu\u00e7uk saat Kad\u0131n memurun tercihi esast\u0131r.<\/p><p align=\"LEFT\">Kamu idarelerinde 657 say\u0131l\u0131 Kanuna tabi kad\u0131n memura, \u00e7ocu\u011funu emzirmesi i\u00e7in do\u011fum sonras\u0131 anal\u0131k izni s\u00fcresinin bitim tarihinden itibaren ilk alt\u0131 ayda g\u00fcnde \u00fc\u00e7 saat, ikinci alt\u0131 ayda g\u00fcnde birbu\u00e7uk saat s\u00fct izni verilir. S\u00fct izninin hangi saatler aras\u0131nda ve g\u00fcnde ka\u00e7 kez kullan\u0131laca\u011f\u0131 hususunda, kad\u0131n memurun tercihi esast\u0131r (Md.104\/D).<\/p><p align=\"LEFT\"><strong>3.2- Amirin Uygun Bulmas\u0131 Halinde Verilen Mazeret \u0130zni<\/strong><\/p><p align=\"LEFT\">10 ( +10 ) g\u00fcn<\/p><p align=\"LEFT\">Devlet Memurlar\u0131 Kanunu, verilmesi kanunen zorunlu olan mazeretleri d\u0131\u015f\u0131nda genel bir d\u00fczenlemeye giderek di\u011fer mazeretlerinde olabilece\u011fini kabul etmi\u015f ve memurlar\u0131n \u00f6z\u00fcrleri sebebiyle bir y\u0131lda on g\u00fcne kadar \u00f6z\u00fcr izni verilebilece\u011fini ve bunlar\u0131n kimler taraf\u0131ndan verilebilece\u011fini d\u00fczenlemi\u015ftir.13<\/p><p align=\"LEFT\">Verilmesi kanunen zorunlu olan mazeret izinleri d\u0131\u015f\u0131nda, merkezde atamaya yetkili amir, ilde vali, il\u00e7ede kaymakam taraf\u0131ndan, birim amirinin muvafakati ile bir y\u0131l i\u00e7inde toptan veya b\u00f6l\u00fcmler h\u00e2linde, mazeretleri sebebiyle Devlet memurlar\u0131na on g\u00fcn izin verilebilir. Zaruret h\u00e2linde, ayn\u0131 us\u00fblle on g\u00fcn daha mazeret izni verilebilir. Bu takdirde, ikinci kez verilen bu izin, y\u0131ll\u0131k izinden d\u00fc\u015f\u00fcl\u00fcr (Md.104\/C).<\/p><p align=\"LEFT\">Kanun h\u00fckm\u00fcn\u00fcn incelenmesinde;<\/p><p align=\"LEFT\">\u2022 Devlet memurunun, y\u0131lda toplam\u0131 on g\u00fcn\u00fc a\u015fmayan \u00f6z\u00fcr izni talebinde bulunabilece\u011fi,<\/p><p align=\"LEFT\">\u2022 Devlet memurunun \u00f6z\u00fcr iznini kullan\u0131lmas\u0131na birim amirinin muvafakat etmesinin gerekece\u011fi,<\/p><p align=\"LEFT\">\u2022 Merkezde atamaya yetkili amir, ilde vali, il\u00e7elerde ise kaymakam taraf\u0131ndan iznin kullan\u0131lmas\u0131n\u0131n<\/p><p align=\"LEFT\">uygun g\u00f6r\u00fclece\u011fi sonucu \u00e7\u0131kmaktad\u0131r.<\/p><p align=\"LEFT\">Mazeret sebebiyle onar g\u00fcnl\u00fck devreler halinde en fazla iki kez bu haktan yararlanma hakk\u0131 Devlet memuruna tan\u0131makta ve ikinci on g\u00fcnl\u00fck s\u00fcrenin Devlet memurunun y\u0131ll\u0131k izninden d\u00fc\u015f\u00fclmesi gerekti\u011fine ayr\u0131ca i\u015faret edilmektedir.14<\/p><p align=\"LEFT\">Verilmesi kanunen zorunlu olan mazeret izinleri d\u0131\u015f\u0131nda, \u0130dari birim amirinin uygun bulmas\u0131 halinde verilen mazeret iznini, \u00f6z\u00fcr izni olarak tan\u0131mlayabiliriz. Ge\u00e7erli mazeretlerin olmas\u0131 halinde verilen izin \u00f6z\u00fcr iznidir.15<\/p><p align=\"LEFT\">Verilmesi kanunen zorunlu olan mazeretleri d\u0131\u015f\u0131ndaki \u00f6z\u00fcrler sebebiyle merkezde atamaya yetkili amir, ilde vali, il\u00e7ede kaymakam \u0130dari birim amirinin muvafakati ile Devlet memuruna bir y\u0131l i\u00e7inde on g\u00fcn \u00f6z\u00fcr izni verilebilir. Zorunlu durumlarda ikinci kez on g\u00fcn daha \u00f6z\u00fcr izni verilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p><p align=\"LEFT\">Ancak, bu takdirde, ikinci kez verilen on g\u00fcnl\u00fck \u00f6z\u00fcr izni Devlet memurunun y\u0131ll\u0131k izninden d\u00fc\u015f\u00fcl\u00fcr. Verilmesi kanunen zorunlu olan mazeret izinleri d\u0131\u015f\u0131ndaki bu izin t\u00fcr\u00fcnde, her \u015feyden \u00f6nce yetkili amirlerin Devlet memurunun \u00f6zr\u00fcn\u00fc kabule de\u011fer g\u00f6rmesi gereklidir. Yetkili amirlerin Devlet memurunun \u00f6zr\u00fcn\u00fc kabule de\u011fer g\u00f6rmez ise \u00f6z\u00fcr izni verilmesi s\u00f6z konusu de\u011fildir.16<\/p><p align=\"LEFT\">Do\u011fum, evlenme ve \u00f6l\u00fcm izinleri Devlet memurlar\u0131 i\u00e7in verilmesi kanunen zorunlu olan mazeret izinleri olmas\u0131na kar\u015f\u0131n \u00f6z\u00fcr izninde durum ayn\u0131 de\u011fildir yani bu izin idarelerde yetkili amirin uygun bulmas\u0131 halinde verilebilir.17<\/p><p align=\"LEFT\">\u00d6z\u00fcr izni, bir y\u0131l i\u00e7inde toptan veya par\u00e7a par\u00e7a olarak on g\u00fcnd\u00fcr.<\/p><p align=\"LEFT\">Dan\u0131\u015ftay bir karar\u0131nda \u00f6zetle; E\u015fin hastal\u0131\u011f\u0131n\u0131n di\u011fer e\u015f i\u00e7in, mazeret izni verilmesini gerektirecek nitelikte kabul edilebilir bir mazeret oldu\u011fu tart\u0131\u015fmaya yer b\u0131rakmayacak kadar a\u00e7\u0131kt\u0131r. Ancak b\u00f6yle bir durumda 657 say\u0131l\u0131 Yasan\u0131n 104. maddesi 10`ar g\u00fcnl\u00fck devreler halinde en fazla iki kez bu olanaktan yararlanma hakk\u0131n\u0131 ilgili kamu g\u00f6revlisine tan\u0131makta ve ikinci on g\u00fcnl\u00fck s\u00fcrenin y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclmesi gerekti\u011fine ayr\u0131ca i\u015faret etmektedir. Belirtilen duruma g\u00f6re, e\u015fin rahats\u0131zl\u0131\u011f\u0131n\u0131n \u00f6ng\u00f6r\u00fclen s\u00fcreleri a\u015fmas\u0131 ve tedavisinin kamu g\u00f6revlisinin e\u015fli\u011fine ( refakatine ) ihtiya\u00e7 g\u00f6stermesi halinde konunun s\u00f6z\u00fc ge\u00e7en Yasan\u0131n 108. maddesinin de\u011fi\u015fik 1. f\u0131kras\u0131 kapsam\u0131nda ele al\u0131nmas\u0131 ve refakatin mazeret izninden say\u0131lmas\u0131 gereken ilk on g\u00fcn\u00fc a\u015fan k\u0131sm\u0131n\u0131n y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclmesi, refakat s\u00fcresinin ikinci mazeret izni ve y\u0131ll\u0131k izin s\u00fcrelerinden fazlaya ait k\u0131sm\u0131 i\u00e7inse ilgiliye, istekte bulunmas\u0131 ko\u015fuluna ba\u011fl\u0131 olarak her defas\u0131nda alt\u0131 ay\u0131 ge\u00e7memek \u00fczere, ayl\u0131ks\u0131z izin verilmesi gerekmektedir. Belirtilen hukuksal duruma g\u00f6re, davac\u0131n\u0131n e\u015fine refakat nedeniyle kullanmaya zorunlu kald\u0131\u011f\u0131 35 g\u00fcnl\u00fck iznin Yasan\u0131n 104. maddesi g\u00f6zard\u0131 edilerek t\u00fcm\u00fcn\u00fcn ad\u0131 ge\u00e7enin y\u0131ll\u0131k izninden d\u00fc\u015f\u00fclmesinde yasaya uyarl\u0131k bulunmad\u0131\u011f\u0131 gibi bu s\u00fcrenin hi\u00e7bir \u015fekilde y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclemeyece\u011fi gerek\u00e7esiyle an\u0131lan i\u015flemin iptali yolunda verilen Mahkeme karar\u0131nda da 657 say\u0131l\u0131 Yasaya uyarl\u0131k g\u00f6r\u00fclmemi\u015ftir. (Dan\u0131\u015ftay 5. Dairesinin 29.10.1992 tarih ve E:1989\/2377\/, K;1992\/2688 say\u0131l\u0131 Karar\u0131).<\/p><p align=\"LEFT\">Dan\u0131\u015ftay bir ba\u015fka karar\u0131nda ise \u00f6zetle; Maliye Bakanl\u0131\u011f\u0131nca haz\u0131rlan\u0131p 09.07.2005 g\u00fcn ve 25870 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan 18 Seri No.lu Y\u00fcksek\u00f6\u011fretim Kanunu ve Y\u00fcksek\u00f6\u011fretim Personel Kanunu Genel Tebli\u011finin 15. maddesinin iptali istenilmektedir. Olayda, y\u0131ll\u0131k izin, \u015fua izni ve d\u00f6ner sermaye faaliyetleri ile ilgili olarak yap\u0131lan ge\u00e7ici g\u00f6revlendirmelerde d\u00f6ner sermaye katk\u0131 pay\u0131 \u00f6denece\u011fi, ki\u015filerin hastanede tedavi g\u00f6rd\u00fckleri ve raporlu olduklar\u0131 s\u00fcreler ile mazeret izni, do\u011fum \u00f6ncesi ve sonras\u0131 kullan\u0131lan izin s\u00fcrelerinde, evlilik izni ve do\u011fum izni v.b. izinlerinde d\u00f6ner sermaye gelirinden pay alamayacaklar\u0131 sonucuna ula\u015f\u0131lmaktad\u0131r. Oysa; 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun mazeret izinlerini d\u00fczenleyen 104. maddesinde ve hastal\u0131k izinlerini d\u00fczenleyen 105. maddesinde getirilen izinler ve hastal\u0131klar s\u0131ras\u0131nda \u00e7al\u0131\u015fanlar\u0131n \u00f6zl\u00fck haklar\u0131na dokunulamayaca\u011f\u0131 yolundaki emredici h\u00fck\u00fcm kar\u015f\u0131s\u0131nda, Genelge ile Yasayla yap\u0131lan d\u00fczenlemeden farkl\u0131 bir d\u00fczenlemeye gidilmesinde normlar hiyerar\u015fisine uyarl\u0131k bulunmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu durumda, Sosyal Devlet ve Hukuk Devleti ilkelerine ve 657 say\u0131l\u0131 Kanunun genel mant\u0131\u011f\u0131na ayk\u0131r\u0131 bir d\u00fczenlemeyle d\u00f6ner sermaye gelirinden pay alacak personeli k\u0131s\u0131tlama yoluna giden dava konusu Tebli\u011f h\u00fckm\u00fcnde hukuka uygunluk g\u00f6r\u00fclmemektedir (Dan\u0131\u015ftay 8. Dairesinin 27.3.2007tarih ve E. 2005\/5657, K. 2007\/1700 say\u0131l\u0131 Karar\u0131).<\/p><p align=\"LEFT\"><strong>4- MAZERET \u0130ZN\u0130N\u0130N YILLIK \u0130Z\u0130NDEN D\u00dc\u015e\u00dcLME(ME)S\u0130<\/strong><\/p><p align=\"LEFT\">Y\u0131ll\u0131k izinlerinin tamam\u0131n\u0131 kullanmam\u0131\u015f, yani y\u0131ll\u0131k izni var iken Devlet memurlar\u0131na mazeret izni verilebilir mi?<\/p><p align=\"LEFT\">Buraya kadar yap\u0131lan a\u00e7\u0131klamalardan anla\u015f\u0131laca\u011f\u0131 \u00fczere, y\u0131ll\u0131k izin ile ilgili d\u00fczenleme Devlet Memurlar\u0131 Kanununun 102\u2019nci maddesinde, mazeret izni ile ilgili d\u00fczenleme ise ayn\u0131 Kanunun 104 nc\u00fc maddesinde ayr\u0131 ayr\u0131 d\u00fczenlenmi\u015ftir.<\/p><p align=\"LEFT\">Mazeret izinleri de; anal\u0131k izni, babal\u0131k izni, do\u011fum izni, evlenme izni, \u00f6l\u00fcm izni, s\u00fct izni ve di\u011fer mazeretler i\u00e7in izin olmak \u00fczere, her bir mazerete g\u00f6re iznin s\u00fcresi ve verilme bi\u00e7imi ayr\u0131 ayr\u0131 belirlenmi\u015ftir.<\/p><p align=\"LEFT\">Kanunda, di\u011fer mazeretler i\u00e7in 102\u2019nci madde d\u0131\u015f\u0131nda denilmemi\u015f, 104 \u00fcnc\u00fc maddenin (A) ve (B) f\u0131kras\u0131n\u0131n d\u0131\u015f\u0131nda denilmekle yetinilmi\u015ftir.<\/p><p align=\"LEFT\">Mazeret izni ile y\u0131ll\u0131k izin ba\u011flant\u0131s\u0131 sadece ikinci kez verilen mazeret izninde bulunmaktad\u0131r. \u015e\u00f6yleki, 104 \u00fcnc\u00fc maddenin (C) f\u0131kras\u0131n\u0131n son c\u00fcmlesinde \u201cZaruret h\u00e2linde, ayn\u0131 us\u00fblle on g\u00fcn daha mazeret izni verilebilir. Bu takdirde, ikinci kez verilen bu izin, y\u0131ll\u0131k izinden d\u00fc\u015f\u00fcl\u00fcr.\u201d \u015feklinde yer alan h\u00fckme g\u00f6re ikinci kez verilen izin y\u0131ll\u0131k izinden d\u00fc\u015f\u00fcl\u00fcr. Bu h\u00fck\u00fcm takdire yer veren de\u011fil, amir bir h\u00fck\u00fcm niteli\u011fi ta\u015f\u0131maktad\u0131r. Dolay\u0131s\u0131yla, ikinci kez verilen on g\u00fcnl\u00fck mazeret izni y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclecektir. Y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclece\u011fi belirtilmeyen, yani y\u0131ll\u0131k izinlerinin bir k\u0131sm\u0131n\u0131 veya tamam\u0131n\u0131 kullanmam\u0131\u015f Devlet memurlar\u0131na 104 \u00fcnc\u00fc maddenin (C) f\u0131kras\u0131na g\u00f6re ilk kez verilecek on g\u00fcnl\u00fck mazeret izninin y\u0131ll\u0131k izinden d\u00fc\u015f\u00fclmemesi gerekir.<\/p><p align=\"LEFT\"><strong>5- SONU\u00c7<\/strong><\/p><p align=\"LEFT\">Devlet Memurlar\u0131 Kanunu, verilmesi kanunen zorunlu olan mazeretleri d\u0131\u015f\u0131nda genel bir d\u00fczenlemeye giderek di\u011fer mazeretlerinde olabilece\u011fini kabul etmi\u015f ve memurlar\u0131n \u00f6z\u00fcrleri sebebiyle bir y\u0131lda on g\u00fcne kadar \u00f6z\u00fcr izni verilebilece\u011fini ve bunlar\u0131n nas\u0131l ve kimler taraf\u0131ndan verilebilece\u011fini d\u00fczenlemi\u015ftir.<\/p><p align=\"LEFT\">Yukar\u0131da belirtilen h\u00fck\u00fcmlerin ve yap\u0131lan a\u00e7\u0131klamalar\u0131n birlikte de\u011ferlendirilmesi sonucunda, y\u0131ll\u0131k izinlerini kullan\u0131p kullanmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n Devlet memurlar\u0131na, 657 say\u0131l\u0131 Kanunun 104 \u00fcnc\u00fc maddesinin (C) f\u0131kras\u0131na g\u00f6re mazeretleri sebebiyle y\u0131ll\u0131k izninden d\u00fc\u015f\u00fclmeden on g\u00fcn mazeret izni verilmesi m\u00fcmk\u00fcn bulunmaktad\u0131r. \u0130kinci kez 10 g\u00fcnl\u00fck mazeret izni de verilebilecektir.
