Giri\u015f<\/p><p>\u0130dare, mevzuattan ald\u0131\u011f\u0131 yetkiyi kullanan ve bu yetkileri uygulayan kamu g\u00f6revlileriyle idari i\u015flemlerini y\u00fcr\u00fct\u00fcr. \u0130dari i\u015flemler ise bir hiyerar\u015fi i\u00e7inde bulunan kamu g\u00f6revlilerinin izin, onay, olur, emir, talimat gibi s\u00f6zl\u00fc veya yaz\u0131l\u0131 hukuki s\u00fcre\u00e7lerin tamamlanmas\u0131yla hayat bulur.<\/p><p>Alt-\u00fcst \u015feklindeki dikey hiyerar\u015fi i\u00e7inde, yetkili amir taraf\u0131ndan verilen bir emir, astlar\u0131 taraf\u0131ndan uygulanarak, idari i\u015flemler bir sonuca var\u0131r. Dolay\u0131s\u0131yla, bir idari i\u015flemin y\u00fcr\u00fct\u00fclmesi i\u00e7in birinin karar almas\u0131 (\u00fcst&#8217;\u00fcn) di\u011ferinin de uygulamas\u0131 (ast&#8217;\u0131n) gerekir.<\/p><p>Bu \u00e7al\u0131\u015fmam\u0131zda, amir taraf\u0131ndan verilen her emrin yerine getirip getirilmeyece\u011fi incelenecektir. Ast, hangi emirler uygulamak zorunda, uygulayamayaca\u011f\u0131 emirler neler ve uygulamak istemedi\u011finde neler yapabilecek?<\/p><p>Bu y\u00f6nde \u00e7al\u0131\u015fma yapmam\u0131z\u0131n da bilin\u00e7li bir tercihi oldu\u011funu s\u00f6yleyebiliriz. Ter\u00f6r \u00f6rg\u00fct\u00fc taraf\u0131ndan organize edilen ve b\u00fcy\u00fck ac\u0131larla son bulan hain darbe giri\u015fimi sonras\u0131nda tart\u0131\u015f\u0131lan &#8220;konusu su\u00e7 te\u015fkil eden emrin&#8221; yerine getirilip getirilmeyece\u011fini mevzuat d\u00fczenlemeleri \u00e7er\u00e7evesinde incelemek, bu konuda \u00e7al\u0131\u015fma yapmam\u0131z\u0131n amac\u0131d\u0131r.<\/p><p>2. Emir Nedir?<\/p><p>Emir kavram\u0131, doktrinde \u015fu \u015fekilde tan\u0131mlanm\u0131\u015ft\u0131r:<\/p><p>&#8220;&#8230;ustunluk yetki ve kudretini haiz bir merci taraf\u0131ndan, belirli bir hareketin yap\u0131lmas\u0131 veya yap\u0131lmamas\u0131 maksad\u0131yla, ast durumunda bulunan kimseye y\u00f6nelmi\u015f ve a\u00e7\u0131klanm\u0131\u015f bir irade beyan\u0131&#8230;&#8221;[<a href=\"#a1\">1<\/a>]<\/p><p>&#8220;&#8230;\u00fcst yetkisini haiz bir iradenin, muayyen bir \u015feyin yap\u0131lmas\u0131 i\u00e7in asta hitap eden bir tezah\u00fcr&#8230;&#8221;[<a href=\"#a2\">2<\/a>]<\/p><p>&#8220;&#8230;hukuk taraf\u0131ndan kabul edilmi\u015f \u00fcst\u00fcn bir kudret ve yetkiye sahip merciin veya \u015fahs\u0131n, muayyen bir davran\u0131\u015fta bulunmak \u00fczere ast durumunda olana y\u00f6neltti\u011fi bir irade beyan\u0131d\u0131r.&#8221;[<a href=\"#a3\">3<\/a>]<\/p><p>Emir kavram\u0131n\u0131n T\u00fcrk Ceza Kanununda ve Askeri Ceza Kanununda tan\u0131m\u0131 olmamakla birlikte, 211 say\u0131l\u0131 \u0130\u00e7 Hizmet Kanunu&#8217;nda yer almaktad\u0131r. An\u0131lan Kanunun 8&#8217;inci maddesinde emir &#8220;hizmete ait bir talep veya yasa\u011f\u0131n s\u00f6zle, yaz\u0131 ile ve sair surette ifadesi&#8230;&#8221; \u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r.<\/p><p>Gerek doktrindeki gerekse de mevzuattaki tan\u0131mdan yola \u00e7\u0131k\u0131larak emirde bulunmas\u0131 gerekenler de ortaya konulabilir:<\/p><p>a. Emir \u00f6ncelikle yetkili amir taraf\u0131ndan verilmelidir. Amirin yetkisi, y\u00fcr\u00fcrl\u00fckteki mevzuata dayanmal\u0131d\u0131r. B\u00f6yle bir hukuki norm olmad\u0131k\u00e7a, amir kendisi hukuk yaratamaz, kural koyamaz. Di\u011fer bir ifadeyle, mevzuata dayanmayan bir emir yerine de getirilmez. Kald\u0131 ki b\u00f6yle bir talimat da &#8220;emir&#8221; olarak da tan\u0131mlanamaz.<\/p><p>211 say\u0131l\u0131 Kanun&#8217;un 15.maddesinde &#8220;Amir; emirlerini maiyetindeki her \u015fahsa verebilir. Vazifelerin zaman\u0131nda ve tam olarak yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131 takip ve yap\u0131lmas\u0131n\u0131 temin eder.&#8221; h\u00fckm\u00fc ile 16. maddesinde yer alan &#8220;Amir; maiyetine hizmetle m\u00fcnasebeti olm\u0131yan emir veremez. Ast\u0131ndan hususi bir menfaat temin edecek bir talepte bulunamaz. Hediyesini kabul edemez ve bor\u00e7 alamaz.&#8221; H\u00fck\u00fcmleri incelendi\u011finde; amirin askere emir verme yetkisinin, hizmetle ili\u015fkili olmak \u015fart\u0131yla, g\u00f6revle ilgili olabilece\u011fini anlamaktay\u0131z.<\/p><p>b. Emir, \u015fekil ve i\u00e7erik olarak gereken \u015fartlar\u0131 ta\u015f\u0131mal\u0131d\u0131r. Unsurlar\u0131 tam olan bir emrin yerine getirilmesi zorunludur. Di\u011fer bir ifadeyle, memur, emrin gere\u011fini ifaya mecburdur, emir memur i\u00e7in ba\u011flay\u0131c\u0131d\u0131r.<\/p><p>657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununda disiplin su\u00e7lar\u0131n\u0131 d\u00fczenleyen 125. maddesinde a\u015fa\u011f\u0131daki su\u00e7 fiilleri say\u0131lm\u0131\u015ft\u0131r:<\/p><p>Uyar\u0131 cezas\u0131 gerektiren fiiller;<\/p><p>a) Verilen emir ve g\u00f6revlerin tam ve zaman\u0131nda yap\u0131lmas\u0131nda, g\u00f6rev mahallinde kurumlarca belirlenen usul ve esaslar\u0131n yerine getirilmesinde, g\u00f6revle ilgili resmi belge, ara\u00e7 ve gere\u00e7lerin korunmas\u0131, kullan\u0131lmas\u0131 ve bak\u0131m\u0131nda kay\u0131ts\u0131zl\u0131k g\u00f6stermek veya d\u00fczensiz davranmak,<\/p><p>K\u0131nama cezas\u0131 gerektiren fiil;<\/p><p>a) Verilen emir ve g\u00f6revlerin tam ve zaman\u0131nda yap\u0131lmas\u0131nda, g\u00f6rev mahallinde kurumlarca belirlenen usul ve esaslar\u0131n yerine getirilmesinde, g\u00f6revle ilgili resmi belge, ara\u00e7 ve gere\u00e7lerin korunmas\u0131, kullan\u0131lmas\u0131 ve bak\u0131m\u0131nda kusurlu davranmak,<\/p><p>Ayl\u0131ktan kesme cezas\u0131n\u0131 gerektiren fiil;<\/p><p>a) Kas\u0131tl\u0131 olarak; verilen emir ve g\u00f6revleri tam ve zaman\u0131nda yapmamak, g\u00f6rev mahallinde kurumlarca belirlenen usul ve esaslar\u0131 yerine getirmemek, g\u00f6revle ilgili resmi belge, ara\u00e7 ve gere\u00e7leri korumamak, bak\u0131m\u0131n\u0131 yapmamak, hor kullanmak,<\/p><p>c. \u015eekil ve i\u00e7erik olarak gereken \u015fartlar\u0131 ta\u015f\u0131mas\u0131 gerekmektedir. Mevzuat emir i\u00e7in bir \u015fekil \u015fart\u0131 koymu\u015f ise bu \u015fekil \u015fart\u0131na uyulmas\u0131 \u015fartt\u0131r. \u015eekil \u015fart\u0131 \u00f6ng\u00f6r\u00fclmeyen durumlarda, emrin konusunun su\u00e7 te\u015fkil etmemesi \u015fartt\u0131r.<\/p><p>Nitekim, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu&#8217;nun, Kanunun h\u00fckm\u00fc ve amirin emri ba\u015fl\u0131kl\u0131 24. Maddesinin 3. F\u0131kras\u0131nda; &#8220;Konusu su\u00e7 te\u015fkil eden emir hi\u00e7bir surette yerine getirilemez. Aksi takdirde yerine getiren ile emri veren sorumlu olur.&#8221; H\u00fckm\u00fc yer almaktad\u0131r. Dolay\u0131s\u0131yla, bir su\u00e7un i\u015flenmesine y\u00f6nelik bir emir asla yerine getirilmeyecektir.<\/p><p>Bunun d\u0131\u015f\u0131nda, an\u0131lan kanunun an\u0131lan maddesinin 2.f\u0131kras\u0131nda ise; &#8220;Yetkili bir merciden verilip, yerine getirilmesi g\u00f6rev gere\u011fi zorunlu olan bir emri uygulayan sorumlu olmaz.&#8221; H\u00fckm\u00fc ile amirin emrinin yetki \u00e7er\u00e7evesinde verilmesi durumunda sorumlulu\u011fun emri verende oldu\u011funu s\u00f6yleyebiliriz.<\/p><p>3. Hukuka Ayk\u0131r\u0131 veya Konusu Su\u00e7 Te\u015fkil Eden Emri Yerine Getiren Memurun Sorumlulu\u011fu<\/p><p>Memur, kendisine verilen emri, yukar\u0131da belirtilen emrin unsurlar\u0131 a\u00e7\u0131s\u0131ndan mutlaka kontrol edilmelidir. Emrin konusunun su\u00e7 oldu\u011funu bilmemek veya \u00e7e\u015fitli nedenlerle (zor kullanma, ba\u015fka alt\u0131nda kalma vb.) mutlak itaatle kabul etmek, sorumluluktan kurtarmayacakt\u0131r.<\/p><p>Di\u011fer taraftan, 2709 say\u0131l\u0131 1982 Anayasam\u0131z\u0131n, kanunsuz emir ba\u015fl\u0131kl\u0131 137.maddesinde a\u015fa\u011f\u0131daki h\u00fck\u00fcmlere yer verilmi\u015ftir:<\/p><p>Kamu hizmetlerinde herhangi bir s\u0131fat ve suretle \u00e7al\u0131\u015fmakta olan kimse, \u00fcst\u00fcnden ald\u0131\u011f\u0131 emri, y\u00f6netmelik, t\u00fcz\u00fck, kanun veya Anayasa h\u00fck\u00fcmlerine ayk\u0131r\u0131 g\u00f6r\u00fcrse, yerine getirmez ve bu ayk\u0131r\u0131l\u0131\u011f\u0131 o emri verene bildirir. Ancak, \u00fcst\u00fc emrinde \u0131srar eder ve bu emrini yaz\u0131 ile yenilerse, emir yerine getirilir; bu halde, emri yerine getiren sorumlu olmaz.<\/p><p>Konusu su\u00e7 te\u015fkil eden emir, hi\u00e7bir suretle yerine getirilmez; yerine getiren kimse sorumluluktan kurtulamaz.<\/p><p>Askeri hizmetlerin g\u00f6r\u00fclmesi ve acele hallerde kamu d\u00fczeni ve kamu g\u00fcvenli\u011finin korunmas\u0131 i\u00e7in kanunla g\u00f6sterilen istisnalar sakl\u0131d\u0131r.<\/p><p>1982 Anayasas\u0131n\u0131n d\u00fczenlemesi incelendi\u011finde kanuna ayk\u0131r\u0131 emir konusunda ikili bir ayr\u0131ma gitti\u011fi g\u00f6r\u00fclmektedir. Emrin pozitif hukuk metinlerine ayk\u0131r\u0131 olmas\u0131 ancak konusunun su\u00e7 te\u015fkil etmemesi birinci ayr\u0131m ve emrin konusunun su\u00e7 te\u015fkil etmesi ise ikinci ayr\u0131md\u0131r. Emrin pozitif hukuk metinlerine ayk\u0131r\u0131 olmas\u0131 ancak konusunun su\u00e7 te\u015fkil etmemesi durumunda ast, amirinden alm\u0131\u015f oldu\u011fu emrin pozitif hukuk metinlerine ayk\u0131r\u0131 oldu\u011funu amirine bildirecektir. Metnin ifade tarz\u0131ndan, memur i\u00e7in bu bildirimin mecburi oldu\u011fu anla\u015f\u0131lmaktad\u0131r. E\u011fer amir, emrinde \u0131srar eder ve yaz\u0131l\u0131 olarak yenilerse emri yerine getirecektir. Bu d\u00fczenleme ile 1982 Anayasas\u0131, yukar\u0131da bahsetti\u011fimiz emrin hukuka uygunlu\u011funu kontrol teorilerinden (emrin \u015fartlar\u0131 ta\u015f\u0131y\u0131p ta\u015f\u0131mad\u0131\u011f\u0131n\u0131 kontrol edilmesi) itiraz veya emrin tekrar\u0131 teorisini (teredd\u00fct edilen emrin tekrarlanmas\u0131 talebinin istenilmesi) benimsedi\u011fi anla\u015f\u0131lmaktad\u0131r.[<a href=\"#a4\">4<\/a>]<\/p><p>Emrin konusunun su\u00e7 te\u015fkil etmesi durumunda ise ast, emri hi\u00e7bir suretle yerine getirmeyecektir. Ast\u0131n emri yerine getirmesi durumunda ast meydana gelen su\u00e7un faili olacakt\u0131r. Bu d\u00fczenleme \u015fekli ile de Anayasam\u0131z i\u00e7erik itibar\u0131yla kontrol teorisini benimsemi\u015f olmaktad\u0131r.[<a href=\"#a5\">5<\/a>]<\/p><p>137&#8217;nci maddenin son f\u0131kras\u0131nda kanunla g\u00f6sterilen istisnalar\u0131n sakl\u0131 oldu\u011fu belirtilmi\u015ftir. Kanunla g\u00f6sterilen istisnalar\u0131n &#8220;askeri hizmetlerin g\u00f6r\u00fclmesi ve acele hallerde kamu d\u00fczeni ve kamu g\u00fcvenli\u011finin korunmas\u0131&#8221; ama\u00e7lar\u0131na y\u00f6nelik olmas\u0131 gereklidir. Kanun koyucuya verilen istisna getirme yetkisi sadece birinci f\u0131kraya y\u00f6neliktir. Her ne kadar istisna getirme yetkisi \u00fc\u00e7\u00fcnc\u00fc f\u0131krada d\u00fczenlense ve ilk bak\u0131\u015fta kanun yapma tekni\u011fi a\u00e7\u0131s\u0131ndan bir ve ikinci f\u0131kralarda d\u00fczenlenen kaidelere istisna getirme yetkisinin verildi\u011fi anla\u015f\u0131labilirse de, ikinci f\u0131krada yer alan &#8220;hi\u00e7bir suretle&#8221; ifadesi, \u00fc\u00e7\u00fcnc\u00fc f\u0131krada yer alan istisna getirme yetkisinin sadece birinci f\u0131krada yer alan kurala y\u00f6nelik oldu\u011fu sonucuna varmam\u0131za neden olmaktad\u0131r.[<a href=\"#a6\">6<\/a>]<\/p><p>Kanun koyucunun, Anayasada kendisine tan\u0131nan istisna getirme yetkisini kulland\u0131\u011f\u0131 alanlar incelenecek olursa, s\u00f6z konusu alanlardaki istisnay\u0131 137&#8217;nci maddenin birinci f\u0131kras\u0131na y\u00f6nelik olu\u015fturdu\u011fu g\u00f6r\u00fclecektir.<\/p><p>Nitekim kamu d\u00fczeni ve g\u00fcvenli\u011fi bak\u0131m\u0131ndan 2559 say\u0131l\u0131 Polis Vazife ve Salahiyet Kanunu&#8217;nun 2&#8217;nci maddesinde 13 bent halinde d\u00fczenlenen durumlarda verilen emrin yaz\u0131l\u0131 olarak istenemeyece\u011fi ifade edilmi\u015f ve istisna d\u00fczenlenmi\u015ftir. Askeri hizmetlerin g\u00f6r\u00fclmesi bak\u0131m\u0131ndan ise kanun koyucu, kanunlarda herhangi bir istisna h\u00fckm\u00fcne yer vermemi\u015ftir.<\/p><p>\u0130\u00e7 Hizmet Kanunu&#8217;nun 14&#8217;uncu maddesinde yer alan &#8220;\u0130cradan do\u011facak mesuliyetler emri verene aittir.&#8221; ifadesi \u00f6\u011fretide, askeri hizmetlerin g\u00f6r\u00fclmesi bak\u0131m\u0131ndan Anayasan\u0131n 137&#8217;nci maddesinin 3&#8217;uncu f\u0131kras\u0131nda yer alan istisna yetkisinin kullan\u0131ld\u0131\u011f\u0131 bir durum olarak g\u00f6rulmu\u015ftur.[<a href=\"#a7\">7<\/a>]<\/p><p>Ancak belirtmeliyiz ki, ilgili madde Anayasan\u0131n 137\/3&#8217;unun kar\u015f\u0131l\u0131\u011f\u0131 de\u011fil, 137\/1&#8217;inin kar\u015f\u0131l\u0131\u011f\u0131d\u0131r. Bu ba\u011flamda askeri hizmetler bak\u0131m\u0131ndan istisna kanunla de\u011fil, \u0130\u00e7 Hizmet Y\u00f6netmeli\u011finin 33&#8217;uncu maddesi ile d\u00fczenlenmi\u015ftir ki[<a href=\"#a8\">8<\/a>], bu durumda Anayasada belirtilen kanunla istisna getirme ilkesine uygun bir d\u00fczenleme yap\u0131lmam\u0131\u015ft\u0131r.[<a href=\"#a9\">9<\/a>]<\/p><p>Bu noktada, Askeri Ceza Kanunu&#8217;nun 41.maddesi \u00f6nem kazanmaktad\u0131r:<\/p><p>C\u00fcr\u00fcmde ve kabahatte i\u015ftirak<\/p><p>\u0130\u015ftirak:<\/p><p>Madde 41 &#8211; 1- Askeri c\u00fcr\u00fcmlerde ve kabahatlerde i\u015ftirak halinde, T\u00fcrk Ceza Kanununun 64 \u00fcnc\u00fcden 67 nciye kadar olan maddeler h\u00fckm\u00fc tatbik olunur.<br \/>2 &#8211; Hizmete m\u00fctaallik hususlarda verilen emir bir su\u00e7 te\u015fkil ederse bu su\u00e7un i\u015flenmesinden emir veren mesuldur.<br \/>3 &#8211; A\u015fa\u011f\u0131daki hallerde maduna da faili m\u00fc\u015fterek cezas\u0131 verilir:<\/p><p>A: Kendisine verilen emrin hudutlar\u0131n\u0131 a\u015fm\u0131\u015f ise,<br \/>B: Amirin emrinin adli ve askeri bir su\u00e7 maksad\u0131n\u0131 ihtiva eden bir fiile m\u00fctaallik oldu\u011fu kendisince malum ise.<\/p><p>Yukar\u0131da yer verilen Kanun maddesi olduk\u00e7a tart\u0131\u015fmaya a\u00e7\u0131k bir d\u00fczenlemedir. \u015e\u00f6yle ki;<\/p><p>&#8211; Hizmetle ilgili olan ve konusu su\u00e7 te\u015fkil eden emrin yerine getirilmesinde emre verene sorumluluk y\u00fcklenmi\u015ftir. Ancak, Anayasa gere\u011fi bu durumda s\u00f6z konusu emrin yerine getirilmemesi gerekmektedir. Anayasam\u0131z konusu su\u00e7 te\u015fkil eden emrin &#8220;hi\u00e7bir&#8221; surette yerine getirilmeyece\u011fini h\u00fckme ba\u011flam\u0131\u015ft\u0131r. Bu durumda ast&#8217;\u0131n sorumluluktan da kurtulmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p><p>&#8211; Madunun (ast&#8217;\u0131n) emri verenle birlikte m\u00fc\u015fterek ceza almas\u0131n\u0131 3.f\u0131kra ile \u015farta ba\u011flam\u0131\u015ft\u0131r. S\u00f6z\u00fc edilen f\u0131kran\u0131n &#8220;B&#8221; bendinde, ast taraf\u0131ndan, adli ve askeri bir su\u00e7 oldu\u011fu bilinmesi \u015fart\u0131na ba\u011flam\u0131\u015ft\u0131r ki, bu da T\u00fcrk Ceza Kanunu&#8217;nun 4.maddesinin 1. F\u0131kras\u0131nda yer alan &#8220;Ceza kanunlar\u0131n\u0131 bilmemek mazeret say\u0131lmaz.&#8221; H\u00fckm\u00fc ile \u00e7eli\u015fmektedir.<\/p><p>Ancak, 6722 say\u0131l\u0131 T\u00fcrk Silahl\u0131 Kuvvetleri Personel Kanunu \u0130le Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun[<a href=\"#a10\">10<\/a>] ile yap\u0131lan de\u011fi\u015fiklik bu hususta ciddi bir kar\u0131\u015f\u0131kl\u0131\u011fa neden olacakt\u0131r.<\/p><table border=\"0\"><tbody><tr><td>\u00d6NCEK\u0130 HAL\u0130<\/td><td>SON HAL\u0130<\/td><\/tr><tr><td><p>EK MADDE 8. &#8211; 26.9.2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun genel h\u00fck\u00fcmleri bu Kanunda yer verilen su\u00e7lar hakk\u0131nda da uygulan\u0131r. Ancak, bu Kanunun fer&#8217;i askeri cezalara ve cezalar\u0131n ertelenmesine ili\u015fkin h\u00fck\u00fcmleri ile zamana\u015f\u0131m\u0131na ili\u015fkin 49 uncu maddesinin (A) bendi h\u00fck\u00fcmleri sakl\u0131d\u0131r.<\/p><p>S\u0131rf askeri su\u00e7lar ile bu Kanunun \u00dc\u00e7\u00fcnc\u00fc Bab\u0131n\u0131n D\u00f6rd\u00fcnc\u00fc Fasl\u0131nda yaz\u0131l\u0131 su\u00e7lar hakk\u0131nda, k\u0131sa s\u00fcreli hapis cezas\u0131na se\u00e7enek yapt\u0131r\u0131mlar ile \u00f6n \u00f6deme h\u00fck\u00fcmleri uygulanmaz.<\/p><p>Kamu g\u00f6revinin \u00fcstlenilmesinden yoksun b\u0131rak\u0131lma veya bu hak ve yetkinin kullan\u0131lmas\u0131n\u0131n yasaklanmas\u0131na dair g\u00fcvenlik tedbirleri, T\u00fcrk Silahl\u0131 Kuvvetleri mensuplar\u0131 hakk\u0131nda, \u00f6ng\u00f6r\u00fclen s\u00fcre kadar a\u00e7\u0131\u011fa \u00e7\u0131kar\u0131lma \u015feklinde uygulan\u0131r. Yedek subaylar ile erba\u015f ve erler hakk\u0131nda bu tedbirin uygulanmas\u0131, askerlik hizmetlerinin tamamlanmas\u0131ndan sonra yerine getirilir.<\/p><p>Yedek subaylar hari\u00e7 olmak \u00fczere subay, astsubay, uzman jandarma ve uzman erba\u015flar ve Milli Savunma Bakanl\u0131\u011f\u0131 ile T\u00fcrk Silahl\u0131 Kuvvetleri kadro ve kurulu\u015funda \u00e7al\u0131\u015fan sivil personel hakk\u0131nda, askeri ve adliye mahkemelerince verilen k\u0131sa s\u00fcreli hapis cezalar\u0131 T\u00fcrk Ceza Kanununun 50 nci maddesinin birinci f\u0131kras\u0131n\u0131n (a), (b) ve (d) bentlerinde yaz\u0131l\u0131 olanlar d\u0131\u015f\u0131ndaki se\u00e7enek yapt\u0131r\u0131mlara \u00e7evrilemez.<\/p><\/td><td><p>Ek Madde 8 &#8211; (Ek: 31\/3\/2005 &#8211; 5329\/1 md.) (De\u011fi\u015fik: 23\/6\/2016 &#8211; 6722\/11 md.)<\/p><p>Askeri mahkemeler ve adli yarg\u0131 mahkemeleri taraf\u0131ndan verilen k\u0131sa s\u00fcreli hapis cezalar\u0131; 16\/6\/1927 tarihli ve 1076 say\u0131l\u0131 Yedek Subaylar ve Yedek Askeri Memurlar Kanunu h\u00fck\u00fcmlerine g\u00f6re askerlik hizmetini yerine getiren y\u00fck\u00fcml\u00fcler ile y\u00fck\u00fcml\u00fc erba\u015f ve erler hakk\u0131nda T\u00fcrk Ceza Kanununun 50 nci maddesinin birinci f\u0131kras\u0131nda belirtilen se\u00e7enek yapt\u0131r\u0131mlara, di\u011fer askeri \u015fah\u0131slar hakk\u0131nda ise ayn\u0131 f\u0131kran\u0131n (a), (b) ve (d) bentlerinde belirtilen se\u00e7enek yapt\u0131r\u0131mlara \u00e7evrilebilir.<\/p><p>Ancak a\u015fa\u011f\u0131daki hallerde k\u0131sa s\u00fcreli hapis cezalar\u0131 se\u00e7enek yapt\u0131r\u0131mlara \u00e7evrilemez:<\/p><p>A) S\u0131rf askeri su\u00e7lardan dolay\u0131 yap\u0131lan yarg\u0131lama sonunda h\u00fckmolunan netice cezan\u0131n d\u00f6rt ay veya daha fazla s\u00fcreli hapis cezas\u0131 olmas\u0131.<\/p><p>B) Fiilin, disiplini a\u011f\u0131r \u015fekilde ihlal etmesi veya birli\u011fin g\u00fcvenli\u011fini tehlikeye d\u00fc\u015f\u00fcrmesi ya da birli\u011fin muharebe haz\u0131rl\u0131\u011f\u0131n\u0131 veya etkinli\u011fini zafiyete u\u011fratmas\u0131 ya da b\u00fcy\u00fck bir zarar meydana getirmesi.<\/p><p>C) Fiilin sava\u015f veya seferberlikte i\u015flenmesi. 1076 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerine g\u00f6re askerlik hizmetini yerine getiren y\u00fck\u00fcml\u00fcler ile y\u00fck\u00fcml\u00fc erba\u015f ve erler hakk\u0131nda verilen k\u0131sa s\u00fcreli hapis cezas\u0131na se\u00e7enek yapt\u0131r\u0131mlar\u0131n yerine getirilmesi askerlik hizmetlerinin sonuna b\u0131rak\u0131l\u0131r.<\/p><\/td><\/tr><\/tbody><\/table><p>Askeri Ceza Kanun&#8217;un eski halinde; &#8220;26.9.2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun genel h\u00fck\u00fcmleri bu Kanunda yer verilen su\u00e7lar hakk\u0131nda da uygulan\u0131r.&#8221; Denilerek, an\u0131lan Kanun&#8217;un 41.maddesinin y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lmas\u0131 s\u00f6z konusu iken, yap\u0131lan bu de\u011fi\u015fikle, 41.maddenin y\u00fcr\u00fcrl\u00fckte kalmas\u0131 sa\u011flanm\u0131\u015ft\u0131r.<\/p><p>4. Konusu Su\u00e7 Te\u015fkil Eden Amirin Sorumlulu\u011fu (Asker A\u00e7\u0131s\u0131ndan)<\/p><p>Askeri mevzuatta konusu su\u00e7 te\u015fkil eden emri veren amirin sorumlulu\u011fu ile ilgili \u00f6zel bir hukum bulunmaktad\u0131r. Askeri Ceza Kanunun 109.maddesinde a\u015fa\u011f\u0131dad\u0131r:<\/p><p>&#8220;Madununa su\u00e7 yapmak i\u00e7in emir verenlerin cezas\u0131:<\/p><p>Madde 109 &#8211; 1. R\u00fctbe veya makam ve memuriyetinin n\u00fcfuz ve salahiyetini suistimal ederek madununa bir su\u00e7unyap\u0131lmas\u0131n\u0131 teklif eden, amir veya mafevk iki seneye kadar hapsolunur.<br \/>2. Su\u00e7 yap\u0131l\u0131r veya yap\u0131lma\u011fa te\u015febb\u00fcs edilirse faili asliye muayyen olan ceza, emir veren hakk\u0131nda (M. 50[<a href=\"#a11\">11<\/a>]) art\u0131r\u0131larak h\u00fckmolunur.&#8221;<br \/>Su\u00e7un i\u015flenmesinin teklif edilmesi ile beraber an\u0131lan Kanun&#8217;un 109. Maddesi uyar\u0131nca amir sorumlu olacakt\u0131r. Konusu su\u00e7 te\u015fkil eden emrin icra edilmesi durumunda ise an\u0131lan Kanun&#8217;un 109\/2 f\u0131kras\u0131 uyar\u0131nca faile verilen ceza amir bak\u0131m\u0131ndan artt\u0131r\u0131larak verilecektir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere askeri mevzuata tabi personel i\u00e7in konusu su\u00e7 te\u015fkil eden emir verme durumunda sorumlulu\u011fu d\u00fczenleyen bu h\u00fck\u00fcm, azmettirme \u015feklindeki sorumlulu\u011fa nazaran daha geni\u015ftir. Zira azmettirme de ba\u011fl\u0131l\u0131k kural\u0131 gere\u011fince konusu su\u00e7 te\u015fkil eden emrin icras\u0131na te\u015febb\u00fcs edilmemesi halinde ceza sorumlulu\u011fu s\u00f6z konusu olmayaca\u011f\u0131 halde, an\u0131lan Kanun&#8217;un m. 109\/1 gere\u011fince su\u00e7a te\u015febb\u00fcs olmasa bile amir bak\u0131m\u0131ndan ceza sorumlulu\u011fu s\u00f6z konusu olabilecektir.[<a href=\"#a12\">12<\/a>]<\/p><p>5. Sonu\u00e7<\/p><p>Anayasam\u0131z, 137&#8217;nci maddesinde ve &#8220;kanunsuz emir&#8221; ba\u015fl\u0131\u011f\u0131 alt\u0131nda bu durumu d\u00fczenlemi\u015ftir. Buna g\u00f6re kamu hizmetlerinde \u00e7al\u0131\u015fan memur, alm\u0131\u015f oldu\u011fu emri hukuka ayk\u0131r\u0131 bulursa bunu amirine bildirecek ve emri yerine getirmeyecektir. Ancak amir, emrinde \u0131srar eder ve yaz\u0131l\u0131 olarak yinelerse emri icra edecektir ki, bu durumda sorumluluk emri verene aittir. Bu kurala, askeri hizmetlerin g\u00f6r\u00fclmesi ve acele hallerde kamu d\u00fczeni ve kamu g\u00fcvenli\u011finin korunmas\u0131 i\u00e7in kanunla istisna getirilebilecektir. Ancak emir, konusunun su\u00e7 te\u015fkil etmesi durumunda hi\u00e7bir \u015fekilde yerine getirilmeyecektir.[<a href=\"#a13\">13<\/a>]<\/p><p>Memurun, amiri taraf\u0131ndan verilen emrin hukuka ayk\u0131r\u0131 oldu\u011funu veya konusunun su\u00e7 te\u015fkil etti\u011fini anlayabilmesi i\u00e7in emrin me\u015frulu\u011funu kontrol etmesi gereklidir. Bu kontrolde memur; emri verenin yetkili olup olmad\u0131\u011f\u0131, emrin g\u00f6rev alan\u0131na girip girmedi\u011fi ve emrin \u015fekil ve i\u00e7erik a\u00e7\u0131s\u0131ndan hukuka uygun olup olmad\u0131\u011f\u0131n\u0131 denetleyecektir.<\/p><p>T\u00fcrk hukuku bak\u0131m\u0131ndan ast\u0131n, amir taraf\u0131ndan verilen emrin konusunun su\u00e7 te\u015fkil etti\u011fini bilmemesi hukuki yan\u0131lma olarak de\u011ferlendirilecek ve TCK m. 4 uyar\u0131nca ast bak\u0131m\u0131ndan bir mazeret te\u015fkil etmeyecektir. Bununla birlikte emrin konusunu te\u015fkil eden su\u00e7un maddi unsurlar\u0131, nitelikli halleri veya haks\u0131zl\u0131k bilincinde yan\u0131lmaya d\u00fc\u015fmesi durumunda TCK m. 30 uyar\u0131nca \u00e7\u00f6z\u00fcme gidilecektir.<\/p><p>Asker bir g\u00f6revli i\u00e7in durum biraz tart\u0131\u015fmal\u0131d\u0131r. \u00d6zellikle, 6722 say\u0131l\u0131 Kanun ile &#8220;26.9.2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun genel h\u00fck\u00fcmleri bu Kanunda yer verilen su\u00e7lar hakk\u0131nda da uygulan\u0131r.&#8221; H\u00fckm\u00fc kald\u0131r\u0131ld\u0131\u011f\u0131ndan; T\u00fcrk Ceza Kanununun birinci kitab\u0131 olan &#8220;Genel H\u00fck\u00fcmler&#8221; askeri personel i\u00e7in uygulanmayacakt\u0131r.<\/p><p>Daha a\u00e7\u0131k bir ifadeyle, T\u00fcrk Ceza Kanunun genel h\u00fck\u00fcmler i\u00e7inde yer alan, &#8220;Ceza kanunlar\u0131n\u0131 bilmemek mazeret say\u0131lmaz.&#8221; H\u00fckm\u00fc askeri personel i\u00e7in uygulanmayacak, Askeri Ceza Kanununun 41.maddesindeki;<\/p><p>&#8220;3 &#8211; A\u015fa\u011f\u0131daki hallerde maduna da faili m\u00fc\u015fterek cezas\u0131 verilir:<\/p><p>A: Kendisine verilen emrin hudutlar\u0131n\u0131 a\u015fm\u0131\u015f ise,<\/p><p>B: Amirin emrinin adli ve askeri bir su\u00e7 maksad\u0131n\u0131 ihtiva eden bir fiile m\u00fctaallik oldu\u011fu kendisince malum ise.&#8221;<\/p><p>H\u00fckm\u00fc uygulanacakt\u0131r. Bu durumda, ast&#8217;\u0131n fiilin su\u00e7 oldu\u011funu bilmesi ortaya konulmad\u0131k\u00e7a, ceza verilememesi sonucunu do\u011furabilecektir.<\/p><p>Yukar\u0131da yer verilen mevzuat h\u00fck\u00fcmleri ile ya\u015fam\u0131n ger\u00e7ekleri aras\u0131nda ciddi farklar oldu\u011fu iddia edilebilir. \u00d6rne\u011fin, amir taraf\u0131ndan, ast&#8217;\u0131n can\u0131na kastedilerek su\u00e7 i\u015flenmesi istenebilir.
